This website, which operates under the domain name pepejeans.com, is administered by the aforementioned company Pepe Jeans London Limited (henceforward, “Pepe Jeans”).
Please read these Conditions carefully before placing an order. If you do not agree with these Conditions, you should not place any orders.
These Conditions of Sale may be modified at any time, which means you should read them each time you place an order.

When you tick the box “I accept the buying conditions” you are declaring that you have read and accept unreservedly these Conditions of Sale, and in particular the following:
1. You may not place a speculative, false, or fraudulent order.
2. You undertake to provide your actual e-mail address, postal address, and/or other contact details.
3. Don’t forget that if you don’t give us all the information we need, we cannot process your order.
In any case, before confirming the purchase order, you must confirm that you accept these Conditions by activating the box “I accept the buying conditions”.
3. AVAILABILITY OF THE SERVICE
The articles offered on this webpage will be available in the Netherlands.
Orders are not sent to post office boxes, so you will need to give us the exact delivery address.
4. HOW TO MAKE THE PURCHASE
See how pleasant and easy shopping is with Pepe Jeans. Once you have chosen the item you want to buy, click on it to select the size, the colour, and the number of items you want.
Once you have selected the size, the colour (if applicable) and the number of items, click on the option Add to basket” and then on the option “Go to shopping bag”, before indicating the mailing details and accessing the payment options.
To make a purchase you will have to register as a Registered User, which will give you the opportunity of (apart from purchasing) receiving our Newsletter, of enjoying discounts and privileges, of accessing your shopping history, and of storing your mailing and invoicing details so you won’t have to enter them again for future purchases. For more information on this point, see Section 14 of these Conditions.
5. ACCEPTING THE PURCHASE AND CONFIRMING RECEIPT OF THE ORDER
The purchase must be accepted by activating the “Buy now” button. After that, please follow the next steps:
(i) Indicate your personal details (including the delivery address) so we can process your order;
(ii) Select the delivery modality;
(iii) Select the payment method;
(iv) Once you have reviewed the order, accept the Purchase Conditions by ticking the corresponding box, and then activate the button “Buy now”.
If you choose to make the payment by credit card or Paypal, you will then be redirected to the safe environment of Barclays or Paypal (as applicable) to make the payment.
Once the purchase has been completed and the payment made, you will receive an e-mail with an identification code for you to be able to check the status of your order.
Nevertheless, you should take into account that all orders are subject to product availability, as indicated in the following section, together with particular compliance with the conditions specified in Section 2.
6. VALIDITY OF THE OFFER AND PRODUCT AVAILABILITY
The offer of the items in www.pepejeans.com shall be valid as long as such offers exists in the referred website, save as for those cases where an end date of the offer is specified, such as in promotions.
In any case, all orders are subject to product availability; if supply or stock difficulties arise, we will refund you any amount that you may have paid.
We reserve the right to withdraw any product from this website at any time.
Deliveries will be made through a courier company.
The delivery times will generally be of a maximum of 5 working days.
These periods may vary according to the specific circumstances of each order, such as the availability of the product chosen or the mailing area. Likewise, in exceptional circumstances the delivery time may be altered by incidents or difficulties in the delivery of the merchandise. In these cases, the delivery time for the good or goods ordered could be of up to 8 working days.
The delivery costs are indicated below:
Standard (general delivery time: 4-5 working days, notwithstanding the exceptions set out above):

Express (delivery time if the order is placed before 13h: 2 working days / delivery time if the order is placed after 13h: 3 working days) - cost: 9€
It should be taken into account that delivery shall be made during business hours at the address you indicate.
We would also stress the importance of you giving us a contact telephone number when you place the order, so that the transport company can contact you in the event of any difficulties with the delivery.
Remember that orders are not sent to post office boxes, so you will need to give us the exact delivery address.

8. PRICE AND PAYMENT
8.1 - Prices
The price of the product will be that stipulated on our website.
All prices are given in EUROS.
The prices included on the website include19% VAT for the Netherlands, and do not include postage costs.
Prices may change at any time, but this will not affect orders for which we have already sent a mailing confirmation.
8.2 - Forms of payment
All purchases can be paid for by the following methods:

- American Express
8.3 - Security during the payment process
The data are transmitted in encrypted form by means of the SSL protocol.
Once you have pressed the corresponding payment button, if you choose to make the payment by credit card you will be directed to a safe website of the bank we work with where you will asked to give your card details (card no., holder, expiry date, and Card Verification value - CVV). Once these details have been entered, the operation will be sent to the entity that issued your card, which will validate the authenticity of the operation.
Once the bank has confirmed the authentication, your card will be charged, or otherwise the order will be cancelled. In any case you will be informed of the result of the operation.
When you make a payment with a card you confirm that it belongs to you.
9. LANGUAGE/S IN WHICH THE CONTRACT CAN BE FORMALISED
The contract can be formalized in English.
10. CUSTOMER ATTENTION

The products are guaranteed against material or manufacturing defects for the legal period.
12. RETURNS POLICY
Pepe Jeans guarantees you the possibility of cancelling your order, provided that the cancellation is notified before the order has been passed to the courier company for delivery. If this is not the case you must wait to receive the order before processing your refund.
Once you receive your order you will have 14 calendar days from the delivery date to cancel the contract and request the return of the product acquired. You must notify Pepe Jeans within this period that you wish to exercise your right of cancelling the contract, using our on-line return form available in the Client Area.

In these cases Pepe Jeans will refund you the money you spent on the purchase by the same means it was received. The refund shall be made in a maximum period of thirty (30) days from the day you cancel your order. Nevertheless, in these cases of exercising the right of cancellation, you must pay the costs of returning the product (except when it has faults or defects, or is a Standard Return), which Pepe Jeans shall deduct from the amount you have spent on the purchase when refunding you such amount.
How to return?
You can return any item purchased on pepejeans.com within 14 calendar days from the delivery date as follows:
• Fill in our on-line return form available in the Client Area to get a Return Number.
• You will have to indicate in such Return Form the delivery modality you prefer:
(i) Standard: in that case UPS shall send you by e-mail a label you will have to print (cost: Free)
(ii) Premium: UPS shall bring you the label when it collects the product or products you want to return (cost: 10,50€).
• You will receive an e-mail from Pepe Jeans confirming that your return has been received and is being processed.
• UPS shall get in touch with you to collect the product(s) (with its wrapper and original labeling, and together with any other documentation that may accompany the same) you wish to return to arrange a suitable date and address.
• Prepare the package and stick the UPS label on the PEPE JEANS box (or any other solid, rigid carton box). With our return service, you will be refunded in the event of theft or loss during delivery to our warehouse.
• The product must be returned in the same conditions as those it had when it was sent.
• All the items you wish to return from the same order must be returned in a single mailing.
• If we have been sent any promotional articles together with the garment or accessory you wish to return, such promotional article(s) must also be sent back
• It must be requested in your customer account within fourteen (14) calendar days after the order was received.
• Send your return from the same Country in which you placed your order. We will not be able to accept returns from different Countries.
• Cash on delivery returns will not be accepted.
• Returns of goods carried out by means different from the one described herein shall not be accepted.
• Refunds will be issued only for properly returned items.
• Returns can only be processed for products acquired at our online shop.

Returns can only be processed for products acquired at our on-line shop.
12.2 FAULTY OR DEFECTIVE PRODUCTS
If the product has a fault or manufacturing defect, please e-mail our Customer Service at email@example.com or contact them by telephone on +31 20 65 51 409 during Customer Service opening hours (Monday to Friday: 09.00 to 18.00, except Spanish national holidays*).
Pepe Jeans will collect the product (together with its original packaging, label, and any additional documentation) from the address and at the time indicated. Pepe Jeans will cover these costs. We will return the price paid for the product, as well as any delivery costs that you may have incurred.
Please note that all products we dispatch are checked carefully to avoid this kind of situation.
13. INFORMATION ON COMPOSITION AND WASHING
To help you with your shopping, we provide you with information on the composition of all garments, as well as washing instructions so you can look after them correctly. This information is available in the details on each item.
14. REGISTERING AS A CLIENT
To place an order you must register as a Client, creating your own account at our on-line shop.
Registering as a Client at our on-line shop will give you the opportunity of receiving our Newsletter, of enjoying discounts, of viewing your shopping history, and of following up the latter by accessing your user account, among other advantages.
To register as a Client, click on the option “Login / Register” and fill in the corresponding fields. When you have registered you will receive an e-mail at the address you have given us to confirm this.
To access your user account, you will have to click on the options “Hi, [your name ] ” and “Access your account” or click on the option “Login / Register” and then enter your e-mail and password.
If you forget your password for accessing your user account, it will suffice to click on the option “Forgot your password” and enter your e-mail, to which you will be sent a message to reestablish your password.
If you choose to register as a Client, the personal details that you give us will be included on a file owned by PEPE JEANS, S.L., with address in Carretera Laureà Miró, 403-405, 08980, Sant Feliu de Llobregat – Barcelona (Spain), telephone number +34 93 632 75 00 and fax number +34 93 632 75 25, with the purposes of sending you commercial notifications by any means, including (as long as you expressly authorize us to do so) by electronic means, and disclosing them to PEPE JEANS LONDON LIMITED, for the purposes of processing your orders and also sending you commercial notifications by any means, including (if you expressly authorize us to do so) by electronic means.
For us to be able to send you commercial notifications by electronic means (such as the Newsletter), when you register you should tick the box to expressly authorize us to send you them. In each commercial notification you receive you will be given the right to cancel their mailing by a simple free process. You will also have the option of cancelling the reception of our Newsletter in your account.
In any case we inform you that you can exercise your rights of access, rectification, cancellation, and/or opposition at any time in your Client account or by sending an e-mail to firstname.lastname@example.org.
15. MODIFYING DATA AND CANCELLING
When making a purchase order, and before confirming it, you will be able to modify your personal data (including but not limited to your delivery address and payment details) at any time. 17. INTELLECTUAL PROPERTY
All the contents of the website (which are enunciative and not limiting, the graphic design, the source code, logos, texts, graphs, illustrations, photographs, and other elements appearing on the website), together with trade names, brands, or distinguishing marks of any kind on the website are protected by law.
Pepe Jeans does not grant any kind of permit or authorization to the User for the use of its industrial or intellectual property rights or of any other right related to its website and the services offered on the same.
The User recognizes and consents that any copyright, registered trademark, or other intellectual property rights on the materials or contents provided as part of the website correspond to us at any time or to those who authorized us for their use, and likewise recognizes that the reproduction, distribution, marketing, transformation, and in general any other form of exploitation by any procedure of all or part of the contents of this website constitutes a violation of the intellectual and/or industrial property rights of Pepe Jeans or of the holder of the same.
This clause will not prevent you from using this website as necessary to copy the information on your order or contact details.
18. WRITTEN NOTIFICATIONS
It will be understood that the written notifications sent to you have been received 24 hours after having being sent to an e-mail address, or three days after the date of the postmark of any letter. If any of these conditions or any of the precepts should be considered invalid, illegal, or cannot be executed in any way by the competent authority, they will be separated from the remaining conditions and precepts which will continue to be valid insofar as this is permitted by law.
20. CONFLICTS RESOLUTION POLICY
In the event that any controversy arises, the parties will have the option of trying to solve the matter out of Court. If no out-of-Court agreement is reached, the competent Court to solve any such controversies shall be the Court of the place where you (the client) have your residence.
